The FDA is now God

Roy Marshall

At what point in the life of a beauracracy does its leaders begin to envision themselves as infallible, as omnipotent, as well, gods.  Well, it seems as if the FDA has reached that point.    It is really a simple problem, raw milk.  Some people want it, some people produce it, and the FDA wants to make sure that it doesn't happen.  In 1987 the FDA issued their edict that it is ILLEGAL to ship raw milk interstate.  If you are in any of the 40 states that do not legally allow the purchase of raw milk, then you can be arrested if you attempt to purchase from a dairy, any raw milk product.  You, the consumer, can be jailed for wanting a product that has known health benefits.

Recently the Farm-To-Consumer Legal Defense Fund filed suit against the FDA to allow consumers the choice to purchase raw milk products.  In April, the FDA responded to the FTCLDF's lawsuit with a rebuttal that brings shivers to my spine when I read it.  Their rebuttal contained the following EXTREMELY outrageous statements:

  1. "There is no absolute right to consume or feed children any particular food."

  2. "There is no 'deeply rooted' historical tradition of unfettered access to foods of any kind."

  3. "Plaintiffs' assertion of a fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish."

  4. The FDA's brief goes on to state that "even if such a right did exist, it would not render the FDA's regulations unconstitutional because prohibiting the interstate sale and distribution of unpasteurized milk promotes bodily and physical health."

  5. "There is no fundamental right to freedom of contract."

What this means is that any person or group of people that wish to purchase, well, any food product; and enter into a buying cooperative, food club, herd share, or contractual agreement will be in violation of FDA LAWS and are subject to criminal prosecution.   You and I are allowed to buy and consume foods that contain known carcinogens, that have no nutritive value; that promote diabetes, hypertension, obesity and cancer; have known and allowable amounts of fecal matter present; have nutrient labeling that allows for a 20% variance and in the case of whole wheat allows for up to 50% of the nutritive germ to be removed; all this, and we are unable to buy raw milk.  The reason is of course simple, money.  Big dairy CANNOT produce viable safe raw milk.  No large factory dairy could improve sanitation to the point where it would be possible.  That is why milk today is LOADED with antibiotics, hormones, fecal matter and residues of pesticides, herbicides and heavy metal contamination.  And that is why pasteurization is a requirement, the amount of fecal matter present in the milk is frightening.  It has to be pasteurized.

Big business fuels the FDA and provides this organization that at one time attempted to regulate our food but which now is nothing more than a stepping stone into high paying jobs for high and mid level FDA mangers to migrate into after green lighting new products and additives to our food.  Those executives that remain within the framework of the organization seem to make decisions that appear to garner the favors of the big business elite in what can only be seen as an open invitation to hire them away at huge salaries for making these ANTI-consumer PRO-business decisions.  Either that or these guys really do consider themselves Godlike.
